ネス情報 特許侵害 － 主観性の余地 はあるか？ 25th March 2021 英国法では、特許クレームの解釈は常に厳密に客観的行為とみなされてきました。クレームの文言の意味は当業者の目を通して検討されるため、申し立てられた侵害がクレームの範囲に含まれるかどうかを判断する上で、被疑侵害者の知識や意図は問題にされません。重要な意味を持つ2017年のEli Lilly v Actavis事件において、英国最高裁判所は英国法に均等侵害を導入することにより、特許保護の範囲を拡大しました。
